These Terms apply to orders placed by consumers through our online store, diagnosepilot.shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity.

Any terms and conditions of the customer that differ from these Terms shall apply only if we have expressly agreed to them.

2. CONTRACTING PARTY

The purchase contract is concluded with:

3. OFFERS AND PRODUCT PRESENTATIONS

The presentation of products in our online store is intended to display our product range.

We make reasonable efforts to ensure that product descriptions, images, technical specifications, and other information are as complete and accurate as possible.

Minor differences in the actual appearance of products may occur, particularly due to different screen and device settings.

The product information and conditions displayed to the customer at the time of ordering shall be relevant to the contents of the order.

4. ORDER PROCESS AND CONCLUSION OF CONTRACT

Customers may select products and add them to their shopping cart.

Before submitting an order, customers may review and, where necessary, correct their information.

By clicking the final order button, the customer submits a binding order for the goods contained in the shopping cart.

A contract is concluded when we accept the order. Acceptance may take place, in particular, through an express order confirmation, a shipping confirmation, or shipment of the ordered goods.

An automatically generated acknowledgement of receipt initially confirms only that we have received the order, unless its contents expressly state otherwise.

5. PRICES

The prices displayed on the relevant product page and during checkout at the time the order is placed shall apply.

Where required by law, final prices displayed to consumers include applicable taxes.

Any additional shipping or other charges will be disclosed to the customer before the binding order is submitted.

6. PAYMENT

The payment methods available in our online store are displayed during checkout.

Payment is made using the payment method selected by the customer.

Third-party payment service providers may be used to process payments. Additional terms and conditions of the relevant payment provider may apply.

Customers are responsible for providing accurate and complete payment information.

7. SHIPPING AND DELIVERY

We deliver to the shipping areas available during checkout.

Available shipping methods, shipping costs, and applicable delivery times will be communicated through our online store or during checkout.

Delivery will be made to the shipping address provided by the customer.

The customer is responsible for providing a complete and accurate shipping address.

Where delivery times are stated, delays may occur due to circumstances beyond our reasonable control. The customer's statutory rights remain unaffected.

8. UNAVAILABILITY OF GOODS

If an ordered product is exceptionally unavailable and we are therefore unable to fulfill the order, we will inform the customer.

Any payments already made for unavailable goods will be refunded accordingly.

The customer's statutory rights remain unaffected.

9. RETENTION OF TITLE

To the extent permitted by applicable law, delivered goods remain our property until payment has been made in full.

10. RIGHT OF WITHDRAWAL

Consumers generally have a statutory right of withdrawal for distance contracts.

Information regarding the requirements, deadlines, procedures, and consequences of exercising the right of withdrawal can be found in our Return & Refund Policy.

Nothing in these Terms limits the customer's statutory right of withdrawal.

11. RETURNS AND REFUNDS

Returns and refunds are handled in accordance with our applicable Return & Refund Policy and mandatory legal requirements.

For questions regarding returns or refunds, please contact us at:

animosource.2kofficial@gmail.com

12. STATUTORY WARRANTY AND DEFECTIVE GOODS

Consumers are entitled to statutory warranty rights and remedies for defective goods.

If a product is defective, damaged, or does not conform to the contract, please contact us at:

animosource.2kofficial@gmail.com

Where possible, please provide your order number and a description of the issue.

Nothing in these Terms limits your mandatory statutory rights.

13. PRODUCT USE

Products must be used in accordance with their product descriptions, operating instructions, safety instructions, and intended purposes.

For diagnostic, testing, or other technical equipment, customers are responsible for checking compatibility with the relevant vehicle, system, or intended application before use, where corresponding compatibility information is provided.

Safety-related work on vehicles should only be carried out by appropriately qualified persons.

Our products and the information they provide are not a substitute for proper inspection, maintenance, or repair by appropriately qualified professionals.

14. LIABILITY

We shall be liable without limitation for damages resulting from injury to life, body, or health where such damages are caused by an intentional or negligent breach of duty.

We shall also be liable without limitation for damages resulting from intentional misconduct or gross negligence and in all cases where liability is mandatory by law.

In the event of a slightly negligent breach of essential contractual obligations, our liability shall, to the extent permitted by law, be limited to foreseeable damages typical of the contract.

An essential contractual obligation is an obligation whose fulfillment is necessary for the proper performance of the contract and on whose fulfillment the customer may regularly rely.

Mandatory statutory liability provisions, including applicable product liability laws, remain unaffected.

15. CUSTOMER ACCOUNTS

Where our online store allows customers to create an account, customers are responsible for keeping their login credentials confidential.

Customers must ensure that the information they provide is accurate and up to date.

If you suspect unauthorized use of your customer account, please contact us immediately.

16. PROHIBITED USE OF THE WEBSITE

Our website may not be used for unlawful or abusive purposes.

In particular, users must not intentionally interfere with the security or functionality of the website, introduce malicious software, or use the website in a manner that violates applicable law or the rights of third parties.

17. INTELLECTUAL PROPERTY

Any use beyond what is permitted by law requires the consent of the relevant rights holder.

Third-party rights remain unaffected.

18. THIRD-PARTY LINKS AND SERVICES

Our website may contain features, content, or links provided by third parties.

External websites and services may be subject to the terms and privacy policies of the relevant third-party provider.

We are not responsible for third-party content to the extent that such liability may lawfully be excluded.

20. FORCE MAJEURE

To the extent permitted by law, we shall not be liable for delays or failure to perform resulting from extraordinary circumstances beyond our reasonable control.

Mandatory statutory consumer rights remain unaffected.

21. CHANGES TO THESE TERMS

We may amend these Terms for future transactions where necessary due to legal, technical, or business changes.

Orders that have already been concluded will generally remain subject to the terms applicable at the time the relevant contract was concluded.

22. APPLICABLE LAW

Contractual relationships are governed by applicable law, subject to mandatory consumer protection provisions.

For consumers whose habitual residence is in Germany, mandatory consumer protection provisions available to them under the law of their habitual residence remain unaffected.

Any choice of law shall not deprive consumers of the protection afforded to them by mandatory provisions of applicable consumer law.

23. DISPUTE RESOLUTION

Consumers retain access to all applicable statutory options for out-of-court and judicial dispute resolution.

Where required by law, we will provide the necessary information regarding dispute resolution separately on our website.

24. SEVERABILITY

If any provision of these Terms is invalid or unenforceable, the remaining provisions shall generally remain unaffected to the extent permitted by law.

Applicable statutory provisions shall apply in place of any invalid or unenforceable provision.
